EU-India Summit Kicks Off Amidst Warnings Of Impact On Medicines Access

The European Union and India today will engage in a high-level meeting in New Delhi with an agenda that includes energy and climate, research and development, and information and communications technologies. But as they enter the meeting, an international health agency and a powerful health advocacy group have issued statements of concern that intellectual property provisions in a bilateral free trade agreement under negotiation will stifle critical generic medicines production in India, putting thousands of poor patients at risk worldwide.

Philippines: IP Office Cannot Issue Injunctions On Counterfeit Claims

The Philippines Justice Secretary has issued an opinion that an agency cannot issue an injunction against an alleged counterfeiter as the complainant must be an actual party with an interest in the case.

India: Novartis Hearing Postponed To February

WIPO Defends Involvement In IP Enforcement Meeting In The Philippines

The World Intellectual Property Organization, a United Nations agency with nearly 200 member states, is under criticism for its connection with a Western industry-heavy event this week in the Philippines aimed at fighting intellectual property counterfeiting and piracy. The concern from technology industry and consumer advocates is that WIPO is involved in an overly one-sided event and did not sufficiently notify its diverse membership or the public of its activities.

Indian Supreme Court To Hear Novartis Challenge To India’s Patent Law

The Indian Supreme Court today is expected to hear Swiss pharmaceutical company Novartis’ case against a provision of Indian patent law aimed at preventing the extension of drug patents for minor changes in existing products, a practice known as evergreening.

EU-India Agreement In WTO Dispute Raises Bar For EU Drug Seizures

India and the European Union announced a written agreement yesterday that puts more conditions on EU customs authorities before they can stop shipments of generic pharmaceuticals passing through Europe. No longer is the existence of an EU patent on passing generics sufficient cause to stop shipments. The agreement suspends a World Trade Organization dispute started by India last year.
