    Edad de Idris rectificada en la OMPI en medio de especulación sobre qué beneficios obtendría

    Kamil Idris, Director General de la Organización Mundial de la Propiedad Intelectual, ha procedido a rectificar su edad, registrada desde hace 20 años en la OMPI, creando todo tipo de especulación de que ganaría inmensamente con el cambio. Más aún, algunos gobiernos y otros buscan si hubo otras instancias en la cuales Idris hubiera informado erróneamente, con el fin de establecer un posible patrón, comentó un funcionario.

    Hace 20 años cuando Idris se incorporó a la OMPI, su fecha de nacimiento quedó registrada inversamente como 1945 en lugar de 1954, confirmó una portavoz de la organización que además señaló que el error ha sido corregido ante las autoridades correspondientes.

    No es claro por qué Idris permitió que el error subsistiera durante 20 años, o por qué decidió rectificarlo ahora. La portavoz afirmó que no existe un límite de edad para los candidatos a la Dirección General de la OMPI, lo que en principio dejaría de lado la motivación de buscar permanecer en el cargo después de alcanzar la edad normal de jubilación, que en la ONU es de 60 0 61 años.

    En una carta enviada a la OMPI el mes pasado por la Dependencia Común de Inspección de la ONU, a la que tuvo acceso Intellectual Property Watch, se afirma que el organismo independiente había recibido informes de funcionarios que denunciaban que la tergiversación de la edad de Idris se presentó en numerosas ocasiones.

    Quizás la pregunta que cabe plantearse es qué obtendría él con la corrección. La Secretaría de la OMPI insiste en que Idris no se beneficiará de la rectificación. Pero funcionarios de la OMPI y de los Estados miembros se han mostrado molestos con la noticia en las últimas semanas y han especulado ampliamente sobre la relevancia de la acción. Muchos de ellos han llegado a sugerir que en el sistema de la ONU Idris podría beneficiarse en casi un millón de francos suizos por el hecho de ser nueve años más joven.

    La base de esta afirmación sigue siendo poco clara y parece haber surgido del argumento según el cual Idris, después de dejar su cargo en la OMPI, continuaría recibiendo un salario, hasta alcanzar la edad de jubilación; una menor edad le permitiría obtener nueve años más de salario. Parece ser que se planteó una indemnización de este estilo dentro de una propuesta de la Secretaría de la OMPI presentada en la reunión de junio del Comité de Coordinación, que es en efecto el órgano ejecutivo de los Estados miembros de la OMPI. Pero los Estados miembros la suprimieron. La OMPI insistió, sin embargo, en que esto ya existe dentro del reglamento del personal de la organización.

    Otra posibilidad es que el ser más joven le permitiría permanecer en el cargo más allá de su actual periodo, que finaliza en 2009. Si desea quedarse, se necesitaría el voto de las tres cuartas partes de los Países miembros para desbancarlo mediante una regla que limite la duración de los directores generales a dos períodos. Idris fue designado Director General en 1997 (a la edad de 43 años).

    La portavoz de la OMPI rechazó rotundamente la especulación sobre algún beneficio, con el argumento de que no hay un límite de edad para el Director General. “La rectificación no tendrá como resultado una extensión del mandato del Director General”, que es decisión de los Estados Miembros, dijo la portavoz.

    Adicionalmente, “el hecho de corregir un error administrativo- una inversión de los números de su fecha de nacimiento de 1945 a 1954- no conlleva un beneficio financiero para el Dr. Idris”, comentó la portavoz. “Se cumplieron todas las formalidades y requisitos necesarios, y los organismos relevantes, a saber, la Caja Común del Personal de las Naciones Unidas y las autoridades suizas competentes, ya han corregido el error.

    La portavoz afirmó que, de hecho, la rectificación “tendrá como resultado una considerable reducción financiera en la pensión del Director General”. Señaló asimismo que “lejos de obtener financieramente provecho de su posición de Director General de la OMPI”, Idris, desde su nombramiento en 1997, ha declinado el salario al que tiene derecho en calidad de Secretario General de la Unión Internacional para la Protección de las Obtenciones vegetales (UPOV), alojada administrativamente también en la OMPI.
