Research Group Identifies Over-Patenting Of Pharmaceuticals In India, Calls For Patent Reform

The tricontinental research group “accessibsa” has found that while the Indian Patent Office rejects 40 percent of pharmaceutical patent applications, it should be rejecting 90 percent of applications to comply with Indian patent law, according to the results of its recent study of Indian patent data.

South Africa: Copyright Amendment Bill Could Be Finished Next Month

CAPE TOWN – The South Africa Parliament’s Portfolio Committee of Trade and Industry is expected to finalise the long-awaited Copyright Amendment Bill next month. But one more round of public comments is being sought in the meantime, with a deadline of this week.

African Health Ministers Approve Roadmap For Medicines Access, Framework To End Cholera

Health ministers from the World Health Organization Africa region last week endorsed a roadmap for access for the years 2019-2023 concerning areas such as fair pricing, intellectual property management, and supply chain management. The previous day, they pledged to implement key strategies to end cholera outbreaks in the African region by 2030.

South Africa’s Proposed Copyright Fair Use Right Should Be A Model For The World

Copyright laws the world over are under massive pressure to reform to fit the digital environment. One key area often in need of reform is in the exceptions to copyright that enable the digital practices. Without exceptions, common practices may be illegal, such as sharing photos on social media, making technical copies to send and stream, and uploading excerpts to closed networks for student access, writes a group of experts on the issue.

Legislation For South Africa’s New IP Policy Likely After Elections Next Year

Legislative changes giving effect to South Africa’s recently published Intellectual Property Policy “Phase 1” will not take place during this term of government, the country’s trade minister has said. Meanwhile, a side-by-side comparison with the 2017 draft legislation shows a series of changes in the final policy, and the pharmaceutical industry is complaining but appears determined to continue investing in the country.

Many hold the view that Gilead’s revolutionary treatment against hepatitis C (sofosbuvir) marked the beginning of a shift in position toward the high prices of medicines, as high-income countries were also faced with an untenable burden to their health systems. In a number of lower and middle-income countries, civil society organised itself to increase access to sofosbuvir for millions in need.
