Nagoya Protocol On Biodiversity Benefit-Sharing Has 64 Signatories

By William New, Intellectual Property Watch on 04/10/2011 @ 10:45 pm

The UN agreement struck last year to bolster access and benefit-sharing related to biodiversity has been gaining signatures rapidly and may be on its way to an early approval, according to the UN Convention on Biological Diversity secretariat. However, while countries are signing, not one has yet had a chance to ratify it.

The Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization (ABS) to the Convention on Biological Diversity was agreed on 29 October 2010 in Nagoya, Japan (IPW, Biodiversity/Genetic Resources/Biotech, 29 October 2010 [1]).

The CBD list of signatories is here [2].

With about 20 new signatures in recent weeks, it now has 64. It requires that 50 countries ratify the agreement at the national level before it takes effect.

CBD press releases on the Nagoya Protocol are here [3].

The statement that “not one has yet had a chance to ratify it” is false. All have had a chance, and none have as of yet. Many perhaps will never do so after doing due diligence, or all will. There is no indication either of fast-tracking or slow tracking, or falling off of the tracks.
