    世界知识产权组织成员国审议2010至2011年计划预算草案

    世界知识产权组织的成员国政府本周认真分析了该组织秘书处提交的2010至2011年度计划和预算草案,该报告第一次全面反映了联合国世界知识产权组织总干事高锐(Francis Gurry)提出的有关组织战略的调整思路。尽管各国政府代表针对该计划方方面面进行了大约200次发言,但是大家好像对秘书处有关两年6.186亿瑞郎(5.772亿美元)的预算建议表示支持。与2008至2009年度相比,预算下降了1.6%或者980万瑞郎。

    7月20日至22日非正式计划和预算委员会会议对秘书处的建议逐行进行了深入分析。
    预算建议与这个期间该组织的预期收入相适应,使其能够达到收支平衡,尽管在全球经济倒退背景下会收取一定服务费,但不会发生动用大量储备资金问题。世界知识产权组织的绝大部分收入都来源于处理全球专利申请的收费。好几个国家的政府官员都说,他们期望秘书处恪守这一预算建议,与此同时,会议建议秘书处能够吸收成员国达成共识的任何新建议,做到这一点并非易事。

    非正式会议不涉及到真刀真枪地进行谈判,但是从发达国家和发展中国家都传出的消息来说,成员国本周表示支持一项建议,以提升世界知识产权组织对中小企业活动的地位。

    根据消息灵通人士的看法,会议提出的问题涉及到使用“计划外预算”,因为一些发展中国家担心,如果要把世界知识产权组织发展议程的资金问题放到这里讨论,那么比纯粹讨论预算或许会更不确定。

    会议代表提出的其他建议或问题则涉及到改进知识产权基础设施的问题,或者质疑“对知识产权尊重”(执行问题)的焦点。

    现任总干事于2008年10月上任。他的战略目标包括:制定一个知识产权标准框架(3050万瑞郎,46名雇员或职位);提供最优秀的全球知识产权服务(2.528亿瑞郎,497个职位);为有利于发展的知识产权运用提供便利(6760万瑞郎,91个职位);全球知识产权基础设施的协调和发展(2130万瑞郎,40个职位);创建一个知识产权信息和分析的世界参考数据库(290万瑞郎,6个职位);对知识产权树立尊重(260万瑞郎,5个职位);有关全球政策问题的知识产权问题(210万瑞郎,5个职位);建立反应灵敏的通讯接口(2680万瑞郎,51个职位);保持一个高效行政管理和财务支持结构(2.05亿瑞郎,297个职位)。

    高锐在给建议草案写的前言中突出了几个战略目标,诸如实施发展议程;更好地把技术援助和能力建设与创新和扩大资金来源渠道融合到一起;对有关版权平衡和局限、例外(包括有视力残疾者有机会获得版权问题)的讨论提供帮助;针对传统知识和传统文化表现方式的保护制定一项国际公约;改进专利合作条约体系;以及扩大世界知识产权组织的仲裁和调解服务。其他战略包括改善世界知识产权组织有关正式产权的法律和统计信息;对假冒伪劣和盗版进行分析;制定诸如“开放的绿色技术创新平台”和为实现联合国千年发展目标而工作的公共政策倡议。另一项目标是减少庸员。

    在其他方面,根据秘书处提供的情况,临近总部大楼的一幢新的办公楼有望按计划于2010年10月完工。但是,秘书处也谋求获得额外资金,来另外建设一个大会厅,并将于2009年9月份召开的世界知识产权组织大会上提交一份可行性报告。

    沮丧情绪

    引起各方长时间讨论的另一个方面的问题就是世界知识产权组织审计委员会的工作延续和组成问题。秘书处至今尚未填补内部审计和监管处的一些职位。一个参加会议的代表指出,对于该委员会来说,一些成员谋求把人员数量减少至5名,因为尽管这样做可能要求更多秘书处资源,但是该部门或许这样可以改进效率。与此同时,其他成员支持维持现在9个成员的现状,以便代表7大地区和两个“联合国专家”。具有神秘色彩的审计委员会建立于2006年,当时大家对世界知识产权组织的财务管理表示担心。该委员会计划将于8月18日至21日复会。但是,该委员会会议的议程没有公开。

    在会议结束之际,与会代表继续认真讨论着计划和预算的建议,并一直对他们自己在一周内表达的观点和建议是否被置之不理表示关切。

    吉罗说,在会议期间,秘书处与委员会 成员们进行了“广泛的”协商。在6月26日的最后一次会议中,秘书处就其计划建议草案做了说明,然后请委员们提问。7月9日,重新开会,秘书处对各方面的问题给予了答复。

    吉罗在最后一个晚上好像对会议失去了耐心,因为与会人员无法对如何推进会议成果达成协议,另外,本来在第一天就提供一份非共识修正建议附件问题达成的协议又重新做了讨论。根据与会代表的说法,他甚至拒绝让至少一名发展中国家成员发言。

    吉罗告诉“知识产权观察”说,会议代表本来在会议伊始就同意召开两天非正式会议,然后在第三天正式开一天会。但是,委员会成员们认真讨论,占用了所有三天时间,一直到最后一天晚上。他说,“一些国家的代表团想对预算加以细致讨论”。但是,他承认秘书处在过去几年引入了一些实质性的变化,或许值得大家深入审议。

    吉罗说,“发展中国家希望世界知识产权组织与发展中国家的关系更加密切”,希望该组织的工作重点能够放到旨在满足其需求的技术援助和计划之上。
